Introduction
The Consumer Protection Division supports and protects the interests of Manitoba consumers, citizens, businesspeople, landlords, and tenants. Under the Consumer Protection Division, the Claimant Adviser Office assists claimants  who disagree with a decision issued by  the Internal Review Office of the Manitoba Public Insurance Corporation (MPIC) with respect to a bodily injury claim. The Claimant Advisor Office also assists claimants with respect to their entitlement to Personal Injury Protection Plan benefits in their appeal of MPIC's decision to  the Automobile Injury Compensation Appeal Commission, an independent, quasi-judicial administrative tribunal. The Claimant Adviser Office is independent from the MPIC and the Automobile Injury Compensation Appeal Commission.

  • A practicing member in good standing, or eligible for immediate membership in the  Law Society of Manitoba
Qualifications:
Essential:
  • Extensive legal experience, preferably in administrative law or litigation
  • Proven leadership skills with the ability to foster and maintain co-operative relationships with external and internal stakeholders  
  • Management experience, including translating strategic priorities into clear operational and business plans and measuring success
  • Experience in successfully creating, fostering and maintaining diverse teams to achieve results through effective human resource management activities such as: recruitment, training,  and performance management 
  • Experience interpreting, applying and explaining statutes, regulations and/or policies
  • Experience in developing strategy, and in providing legal advice and making recommendations
  • Excellent analytical skills, including the ability to recognize and assess legal implications and policy options and ramifications
  • Ability to provide legal advice on complex and high profile issues of law and policy, in a time-sensitive environment to meet conflicting deadlines
  • Experience managing financial resources 
  • Experience in dispute and conflict resolution and excellent negotiation skills  
  • Experience in written or verbal submissions in adversarial proceedings 
  • Experience in witness examination and cross-examination  
  • Excellent organizational and time management skills
  • Superior written communication skills
  • Strong verbal communication and presentation skills

Desired:
  • Experience in reviewing medical and paramedical reports  
  • Knowledge of medical terminology
     
Duties:
Reporting to the Assistant Deputy Minister, the Director is accountable for leading a team of Claimant Advisors and administrative staff and for the day-to-day operation of the Claimant Adviser Office.  The Director  ensures that appeals are investigated appropriately and that appellants receive timely and knowledgeable advice, and are represented at mediation, in settlement discussions and at appeal. Major responsibilities include providing leadership to staff, legal advice/guidance to Claimant  Advisers, timely triage of new appeals, developing and implementing training for staff, developing appropriate policies, procedures and performance standards and monitoring compliance. The Director acts as a claimant adviser and/or coaches claimant advisers on complex files and liaises with the Director of Appeals at the Automobile Injury Compensation Appeal Commission, the Automobile injury Mediation Office and counsel at MPIC.
